Under the Department of Transportation’s testing rules in 49 CFR Part 40, the Medical Review Officer is the independent physician who stands between the laboratory and the employer. The lab reports a result; the MRO decides whether that result is verified before the designated employer representative (DER) ever sees it.
For CDL drivers, MROs must report verified positive, adulterated and substituted results, and certain refusals, to the FMCSA Drug & Alcohol Clearinghouse within the timeframe the rule sets. We handle these entries as part of your per-result price, so employers and C/TPAs don’t have to chase the MRO for Clearinghouse entries.
49 CFR 40.121 requires an MRO to be a licensed physician who has completed MRO qualification training, passed an examination given by an HHS-approved MRO certification board, requalifies every five years and keeps up continuing education. Yes. Under 49 CFR 40.121, a licensed physician who meets the MRO training, examination and requalification requirements can act as MRO for DOT-covered employees wherever they are located.
The MRO reviews the lab report and custody form, then contacts the donor for a confidential interview. If there is a legitimate medical explanation, such as a valid prescription, the result is reported as negative. If not, it is verified and reported to the employer.
Yes. For CDL drivers we report verified positive, adulterated and substituted results, and applicable refusals, to the Clearinghouse as the rule requires. It is included in the per-result price.
Under Part 40, the donor has 72 hours after the MRO notifies them of a verified positive, adulterated or substituted result to request a test of the split specimen.
